«A genuine literary treatment of the soul» is what Eugenio Massa called the brief section of Egidio of Viterbo’s Sentences Commentary that he published in 1954. What Massa published is Egidio’s discussion of part of Peter Lombard’s third distinction in Book I, which bears the title «De imagine et similitudine Trinitatis in anima humana». The main topic at so early a place in the Sentences is not, strictly speaking, the human soul but the divine Trinity. The point of departure is (...) Lombard’s consideration of the soul as analogous to the Trinity; and behind that connection lies Augustine, who presented the soul as an image of the Trinity because he saw in the soul a unity and simplicity of substance but also Platonism’s tripartite divisions. These include, for example, the appetitive, emotional, and rational functions, from the Republic, and Augustine’s subdivision of the rational functions into memory, understanding, and will. This connection between Trinity and human soul, however, gave commentators excellent opportunities not only for theology, discourse about God, but also for psychology, the study of the soul. Descriptions of the human soul initially offered in the theological context became important in their own right. According to Massa, in light of the soul’s being created in God’s image, Egidio was able to make human dignity the major theme even at this early point in the commentary. (shrink)

Most growth models for complex networks consider networks comprising a single connected block or island, which contains all the nodes in the network. However, it has been demonstrated that some large complex networks have more than one island, with an island size distribution obeying a power-law function Is~s-α. This paper introduces a growth model that considers the emergence of islands as the network grows. The proposed model addresses the following two features: the probability that a new island is generated (...) decreases as the network grows and new islands are created with a constant probability at any stage of the growth. In the first case, the model produces an island size distribution that decays as a power-law Is~s-α with a fixed exponent α=1 and in-degree distribution that decays as a power-law Qi~i-γ with γ=2. When the second case is considered, the model describes island size and in-degree distributions that decay as a power-law with 2<α<∞ and 2<γ<∞, respectively. (shrink)

The traditional Dung networks depict arguments as atomic and study the relationships of attack between them. This can be generalised in two ways. One is to consider various forms of attack, support, feedback, etc. Another is to add content to nodes and put there not just atomic arguments but more structure, e.g. proofs in some logic or simply just formulas from a richer language. This paper offers to use temporal and modal language formulas to represent arguments in the (...) class='Hi'>nodes of a network. The suitable semantics for such networks is Kripke semantics. We also introduce a new key concept of usability of an argument. This is the beginning of a continuing research for adding contents to the nodes of an argumentation network. This research will allow us to address notions like ?what does it exactly mean for a node to attack another? or ?what does it mean for a network to be consistent? or ?can we give proper proof rules to manipulate networks?, and more. D.T. a 35-year-old woman, was found to have breast cancer. At the time of mastectomy axillary lymph nodes were positive and the cancer was classified as adenocarcinoma, grade 4. The patient underwent conventional chemotherapy. When it became apparent the disease was metastatic, the patient's oncologist contacted a well-known cancer center regarding the possibility of treating the patient with high dose chemotherapy and autologous bone marrow transplantation. The patient's health insurance provider informed the patient, however, that the treatment—estimated to cost (...) in the range of $150,000–200,000—was “considered experimental or research in nature” and therefore was not included in coverage. D.T. did not pursue this further. Approximately 2 years later, cancer was detected in the patient's spine. This time she applied to another well-known cancer center for HDC/ABMT. The cancer center agreed to accept her on the condition of proof of ability to pay for the treatment. Again her insurer refused coverage on the same grounds as before. D.T. found another source for the money, underwent treatment, then sued the insurance carrier. She sought a declaratory judgment that the treatment was covered under the insurance policy. The court ruled in favor of D.T. finding the contract phrase “considered experimental” ambiguous. (shrink)

Live donor kidney transplantation is the best treatment option for most patients with late-stage chronic kidney disease; however, the rate of living kidney donation has declined in the United States. A consensus conference was held June 5-6, 2014 to identify best practices and knowledge gaps pertaining to live donor kidney transplantation and living kidney donation. Transplant professionals, patients, and other key stakeholders discussed processes for educating transplant candidates and potential living donors about living kidney donation; efficiencies in the living donor (...) evaluation process; disparities in living donation; and financial and systemic barriers to living donation. We summarize the consensus recommendations for best practices in these educational and clinical domains, future research priorities, and possible public policy initiatives to remove barriers to living kidney donation. The present volume, a tribute to Harry Dondorp, contains contributions to the symposium held on the occasion of his farewell at the Vrije Universiteit Amsterdam. Written by four eminent scholars in the field of legal history, the contributions are related to his areas of interest: delictual liability, Romano-canonical procedure and comparative law texts. Multiple -conclusion logic extends formal logic by allowing arguments to have a set of conclusions instead of a single one, the truth lying somewhere among the conclusions if all the premises are true. The extension opens up interesting possibilities based on the symmetry between premises and conclusions, and can also be used to throw fresh light on the conventional logic and its limitations. This is a sustained study of the subject and is certain to stimulate further research. Part I reworks (...) the fundamental ideas of logic to take account of multiple conclusions, and investigates the connections between multiple - and single - conclusion calculi. Part II draws on graph theory to discuss the form and validity of arguments independently of particular logical systems. Part III contrasts the multiple - and the single - conclusion treatment of one and the same subject, using many-valued logic as the example; and Part IV shows how the methods of 'natural deduction' can be matched by direct proofs using multiple conclusions. In his 1922/1923 articles for the Japanese magazine _Kaizō_, Edmund Husserl identifies a particular “humanity” or human culture by the purposeful idea [_Zweckidee_] consciously embraced by the community. This purposeful idea is attained through rational self-formation on the part of the community in a manner analogous to the rational self-formation of the individual human being. Thereafter, it can be referenced to distinguish different cultures (or stages of cultural development) from one another through its objective manifestation in communal groups and cultural (...) products, as Husserl retraces in a historical account of the development of Western history. This paper explores the essential character of this conception of the purposeful idea from both an exegetical and a systematic perspective, examining in particular the relationship between such an idea and the values experienced by individual subjects within a culture (which are, according to Husserl, also available at the level of objective culture in relation to a communal subject). The paper argues that Husserl’s basic conception of the purposeful idea is a good model for understanding certain essential characteristics of cultural constitution in general, although some of his fundamental assumptions—especially the strict identity he attempts to establish between a purposeful idea as such and the specific goal of universal, rational self-understanding—turn out to be somewhat more questionable in light of the connection between the purposeful idea and the genuinely felt values underlying it. Background: The traditional approach to resolving ethics concerns may not address underlying organisational issues involved in the evolution of these concerns. This represents a missed opportunity to improve quality of care “upstream”. The purpose of this study was to understand better which organisational issues may contribute to ethics concerns. Methods: Directed content analysis was used to review ethics consultation notes from an academic children’s hospital from 1996 to 2006 (N = 71). The analysis utilised 18 categories of organisational issues derived (...) and modified from published quality improvement protocols. Results: Organisational issues were identified in 68 of the 71 (96%) ethics consult notes across a range of patient settings and reasons for consultation. Thirteen of the 18 categories of organisational issues were identified and there was a median of two organisational issues per consult note. The most frequently identified organisational issues were informal organisational culture (eg, collective practices and approaches to situations with ethical dimensions that are not guided by policy), policies and procedures (eg, staff knows policy and/or procedural guidelines for an ethical concern but do not follow it) and communication (eg, communication about critical information, orders, or hand-offs repeatedly does not occur among services). Conclusions: Organisational issues contribute to ethical concerns that result in clinical ethics consults. Identifying and addressing organisational issues such as informal culture and communication may help decrease the recurrence of future similar ethics concerns. (shrink)

This article analyzes the complex relation of phenomenology and literature in the work of Husserl and Derrida. In the first part, I show that the limited ideality of the literary object necessarily situates it in a derivative region of phenomenology. In the second part, however, I problematize the regional status of literature by elaborating a brief but important footnote in which Husserl broadens the concept of literature to embrace all cultural products whatsoever. Yet, because even this broadened concept of literature (...) ultimately remains secondary for the phenomenologist, it only redoubles and ratifies the submission of literature to the more ideal objectivities of mathematical disciplines like geometry. The third part, finally, mobilizes Derrida’s notion of “dissemination,” prepared in and unintelligible apart from his early engagement with Husserlian phenomenology, in order to broach a notion of literature that the phenomenologist can neither circumscribe nor describe. The ordinary concept of death is analysed and compared with revisionary medical definitions, especially those based on irreversible loss of brain function. Prior critics of revisionary definitions have focused on the locus, the brain; I am concerned with the irreversibility condition. I argue that 1) the irreversibility condition is ambiguous, 2) it has unacceptable epistemic and other consequences on any plausible construal, and 3) irreversibility is not part of the ordinary concept of death. I conclude that recent medical definitions seek (...) illegitimately to obtain the certainty of a weak construal of 'irreversible' along with the freedom from moral obligation of the strong construal. An appropriate kind of curved Hilbert space is developed in such a manner that it admits operators of $\mathcal{C}$ - and $\mathfrak{D}$ -differentiation, which are the analogues of the familiar covariant and D-differentiation available in a manifold. These tools are then employed to shed light on the space-time structure of Quantum Mechanics, from the points of view of the Feynman ‘path integral’ and of canonical quantisation. Presumably it is common ground that this verb has in addition to the basic sense ‘recognize’ the derivative sense ‘oread’, and that one must judge from the context whether reading to one or more other people, or private reading, is meant. The reading of the text of a law to a jury at an orator's request is marked by the circumstances themselves as public reading; so is the reading of the Athenian decree to the Mitylenaeans in Thucydides. When Theaetetus answers (...) in the affirmative the question whether he has read the book of Protagoras which contains the statement that man is the measure of all things (); or when it is asked ‘Why is it that some people, if they begin to read, are overcome by sleep even against their will, whereas others wishing to be overcome by sleep are kept awake by taking up a book?’ Evidently what is intended is reading in the privacy of one's own room. When Socrates in the Phaedo says that he heard a person reading from Anaxagoras and eagerly took the book home to read, both senses are found within a few pages. (shrink)

This article aims at linking empirical research to legal theories, in a way that could enhance the benefits of this synergy. Jurisprudence, until recently the usual term for theoretical approaches to law, is now often replaced by the term legal theory. Difference between legal theory and empirical research is reflected in their consideration of subject matters, aims, and methods of research. However, there also exist commonalities between the two, i.e. both aim at comprehending law and legal systems. While legal theory (...) uses philosophical tools, its subject matter still remains a social phenomenon, for social ends. And since empirical research is a means to gather information about law, it could act as a prime source of information for legal theory. While empirical research has its own end to follow, what is missing is, attention to some legal theory, not just general legal theory, but which can also critique philosophical discourses to legality.
